This Royal Decree establishes a series of requirements that needs to be meet by housing rental, the rule is intended to provide a quality and improvement service (JUNTA DE ANDALUCIA BOJA 11-02-2016).

This is to comply with public safety and protection of users and their rights, sustainable development of the area concerned and especially having a tourism housing census in Andalucía.

Basically, the requirements are directly related to the provision of service, the endowment of quality basic supplies, attention and the information of users of this type of accommodation.

  • CONTROL AND REGISTRATION OF GUESTS

Article 12 of the Organic Law 1/1992, of February 21ST, on Protection of Public Security, states that natural or legal persons who develop activities relevant to citizen security, including lodging, must carry out the Documentary record actions and information provided in the current regulations.

Spain also undertook, under Article 45 of the Convention implementing the Schengen Agreement of 19TH June 1990, to take the necessary measures to carry out checks on travellers using lodging establishments.

The obligation to complete the registration book, as well as to submit or forward to the corresponding Police Stations or Civil Guard Posts, where appropriate, the entry part of travellers, made according to official model, is imposed by the nature of the activity on which it falls, without prejudice to the application of procedures which, in accordance with the evolution of the technique, allow establishments greater flexibility and economy, provided that this does not detract from the Security to ensure the effectiveness of such control.
